Spain Imposes Compensation for Denial of Parental Leave

Spain’s Supreme Court has issued a ruling requiring several companies to pay financial compensation after refusing to grant some employees their legally entitled parental leave.

The decision followed a series of lawsuits filed by female employees whose requests for leave were denied despite being legally entitled, considered a violation of fundamental workers’ rights to work-life balance.

The compensation ordered by the court ranged from €7,501 to €8,000 per case, after the Supreme Court reduced amounts previously set by lower courts.

Spanish laws, in line with European Union directives, grant parents with children under a certain age the right to request parental leave, either continuously or intermittently, according to specific conditions and procedures.

The courts clarified that the refusal to grant leave was unjustified under existing labor regulations, causing direct harm to the employees’ rights and warranting financial compensation.

These rulings highlight the strict stance of the Spanish judiciary in protecting workers’ rights and ensuring employers comply with legal obligations in Spain’s increasingly complex labor market.
